4. Merchandise Purchases

All merchandise purchases are subject to product availability. We may limit quantities, discontinue products, correct pricing errors, and refuse or cancel orders in our discretion. Product descriptions, colors, sizes, and images are intended to be as accurate as reasonably possible, but we do not guarantee that all descriptions or displays will be completely error-free or match exactly as viewed on your device.

5. Payments and Taxes

All sales are final and no refunds will be issued for memberships, registration fees, or merchandise except in the case of a verifiable injury that prevents participation. Any request for an injury-based refund must be submitted in writing within a reasonable time and must include documentation sufficient to verify the injury. We reserve the right to determine, in our reasonable discretion, whether the submitted documentation supports a refund, full or partial, and whether any administrative, already-incurred, or nonrecoverable costs will be excluded from the refund amount.

7. Member Conduct

You agree to use our website, services, and programs lawfully and respectfully. You may not misuse the website, interfere with platform security, impersonate another person, submit false information, infringe intellectual property rights, engage in abusive or disruptive conduct, or use our services in a way that could harm AP Express, its staff, coaches, members, participants, or the public. We may remove content, suspend access, refuse service, or terminate memberships or accounts for violations of these Terms and Conditions or applicable rules.

8. Assumption of Risk

Participation in sports, training, conditioning, clinics, camps, competitions, events, and related activities involves inherent risks, including the risk of physical injury, illness, permanent disability, or property damage. By participating in any AP Express activity, you acknowledge and voluntarily assume all such risks to the fullest extent permitted by law. You are responsible for determining whether you or the participant is physically able to participate and for consulting a qualified medical professional when appropriate.

9. No Medical Advice or Guarantee of Results

Any training, coaching, fitness, or sports-related information provided by AP Express is for general informational purposes only and is not medical advice. We do not guarantee any particular athletic, competitive, personal, or commercial outcome from participation, training, or membership.

10. Intellectual Property

All content on our website and in our materials, including text, graphics, branding, logos, images, videos, program content, and other materials, is owned by or licensed to AP Express and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, publish, or exploit our content except as expressly permitted in writing.

11. Privacy

Your use of our website and services may involve the collection and use of personal information needed to create accounts, process purchases, administer memberships, and operate programs. By using our website and services, you consent to our collection and use of information as described in any applicable privacy notice or privacy policy we make available.

12. Suspension and Termination

We reserve the right to suspend or terminate your account, membership, order, or access to any service at any time if we believe you have violated these Terms and Conditions, provided false information, engaged in misconduct, created risk or liability, or harmed our operations or community. Termination does not waive any payment obligations already incurred.

13. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, our website, services, memberships, programs, and merchandise are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, AP Express and its owners, officers, employees, contractors, volunteers, coaches, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, opportunities, or business arising out of or related to your use of our website, merchandise, memberships, or programs. These Terms and Conditions are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms and Conditions, your account, a membership, a purchase, or participation in AP Express activities shall be brought exclusively in the state or federal courts serving Montgomery County, Texas, and you consent to the jurisdiction and venue of those courts.

Our failure to enforce any provision will not constitute a waiver of that provision.
